Commissioner Litsky called the meeting to order at 7:01 p.m.  During the meeting, Vice-Chair Commissioner Siegel took the gavel.  For these minutes, “Commissioner Litsky did not vote” means “Commissioner Litsky was absent.”

Present: Commissioners Hamilton, Jorgensen, Litsky, McBee, Siegel, Sobelsohn.

Absent: Commissioner Moffatt.

1.  Agenda.

Commissioner Sobelsohn moved/Commissioner Siegel seconded to approve the agenda as proposed.  Without objection, and at the motion of the following commissioners, the motion to approve the agenda was amended as follows:

     a.  Commissioner Litsky: move up discussion of “Ziegfield’s” and rename item “Ziegfeld’s/Secrets”; add discussion of Potbelly Sandwich Works’ public-space permit application.

     b.  Commissioner Siegel: add discussion of curb cut and bus shelter in ANC 6D07.

Commissioner Sobelsohn clarified that he understood his motion to exclude projected times each agenda item was to start and finish.  As chair, Commissioner Litsky rejected this clarification.  The motion passed 3-1, with Commissioner Sobelsohn opposed.  Commissioners Hamilton and McBee did not vote on this motion.

2.  October Minutes.

Commissioner Sobelsohn moved/Commissioner Siegel seconded to approve the proposed October 19, 2009 minutes.  The motion passed 4-0.  Commissioners Hamilton and McBee did not vote on this motion.

3.  Zoning and Public-Space Permits.

     a.  Old Friendship Baptist Church.

In fall 2005, the Zoning Commission approved a Planned Unit Development (PUD) for the Old Friendship Baptist Church, at the corner of Delaware Ave. and H St., SW.  The property owner has applied for a two-year extension of its PUD.  Commissioner Sobelsohn moved/Commissioner Siegel seconded to advise the DC Zoning Commission to approve the pending application, by Square 643 Associates LLC, for a two-year extension of the Planned Unit Development for Zoning Case #03-30B (Old Friendship Baptist Church, 734 First Street, SW) on condition the applicant commit to monthly litter clean-up of the Randall Park ballfields, starting on the date the applicant applies for the building permit on Square 643.  Commissioner McBee moved/Commissioner Sobelsohn seconded to amend the motion to add that we find maintaining the church building to be the outstanding community benefit of this project.  Without objection, the motion was so amended.  As amended, the motion passed 6-0.

     b.  Potbelly Sandwich Works.

In fall 2007, the Public Space Committee granted Potbelly Sandwich Works permission to set tables and chairs on the sidewalk in front of 409 3d St., SW, each year from April through October.  Potbelly has applied for permission to keep those tables and chairs on the sidewalk year-round.  Commissioner Sobelsohn moved/Commissioner McBee seconded to advise the DC Department of Transportation’s Public Space Committee (PSC) to delay its final decision on the Potbelly Sandwich Works application, permit tracking #51496, until after the December 14 ANC 6D business meeting; and to advise the PSC also to grant the application in the interim, but limited to November and December 2009.  The motion passed 6-0.

4.  Transportation.

      a.  One-Way Street.

Commissioner Siegel moved/Commissioner McBee seconded to ask the DC Department of Transportation (DDOT) to change 4th St., SE, between the Southeast/Southwest Freeway and M Street, SE, from a one-way street to a two-way street.  The motion passed 5-0.  Commissioner Sobelsohn abstained.

     b.  Curb Cut.

Commissioner Siegel moved/Commissioner Jorgensen seconded to ask DDOT to investigate whether a curb cut is necessary at the entrance to 900 5th St., SE.  Commissioner Siegel moved to amend his motion instead to ask DDOT to construct a curb cut at the entrance to 900 5th St., SE.  Without objection, the motion was so amended.  Commissioner McBee moved to amend the motion to add, to the request, the explanation that this curb cut would facilitate the movement of people between the building and vehicles in the street.  Without objection, the motion was so amended.  As amended, the motion passed 6-0.

     c.  Bus Shelters.

Commissioner Siegel moved/Commissioner Hamilton seconded to ask DDOT to build a bus shelter on the north side of the 900 block of 5th St., SE.  Commissioner Jorgensen moved/Commissioner Sobelsohn seconded to amend the motion to add a request to build a bus shelter on the northeast corner of 7th and I Streets, SW. Without objection, the motion was so amended.  As amended, the motion passed 6-0.

5.  Liquor License.

At a meeting May 20, 2009, of the Alcoholic Beverage Control (ABC) Board, the ABC Board requested a security plan from Ziegfeld’s/Secrets, a bar at 1824 Half St., SW.  Commissioner Siegel moved/Commissioner Jorgensen seconded to advise the ABC Board to make twelve (12) specific changes in Ziegfeld’s proposed security plan; and to send a copy of that list to Allen Carroll, the owner of Ziegfeld’s/Secrets.  A list of those 12 changes is attached to these minutes.  The motion passed 6-0.

6.  Announcements, Presentations, and Reports.

     a.  Next Public ANC Meeting.

Commissioner Litsky announced that ANC 6D’s next business meeting will start 7 p.m. Monday, December 14, in the sanctuary of St. Augustine’s Episcopal Church, 600 M St., SW.

     b.  Public Safety.

First District MPD Sergeant Jeffrey Newbold reported that, in Police Service Area 104, comparing September 9-November 8 2008 with the same period in 2009, homicides are down 50% (from 2 to 1), robberies without a gun are down 72% (from 18 to 5), and robberies with a gun are up 100% (from 2 to 4).  Total violent crime is down 27% (from 37 to 27 incidents), and total crime is down 13% (from 132 to 115 incidents).
    
     c.  Washington Nationals.

Commissioner McBee announced that the Washington Nationals have agreed to “make over” the Unity Health Clinic on Delaware Ave., to help care for the King-Greenleaf and Randall ballfields, and to provide a summer baseball clinic for selected Southwest youth.

     d.  Tommy Wells.

Ward Six resident and council staff person Naomi Mitchell announced that, from 8-9:30 a.m. Thursday, November 12, Ward Six Councilmember Tommy Wells will hold office hours at Hogate’s, 800 Water St., SW.  From 6-8 p.m. Monday, December 7, Councilmember Wells will host his annual Livable Walkable Awards ceremony in Eastern Market’s North Hall, at the corner of 7th St. and North Carolina Ave., SE.

     e.  Swine-Flu Vaccinations.

Alex Rotan, of the mayor’s Office of Community Relations & Services, announced that, from 8 a.m.-1 p.m. Saturday November 14, the city will offer free swine-flu shots for high-risk residents at the Eliot-Hine Middle School, 1830 Constitution Ave., NE.

     f.  Mayor’s Fix-It.

Joshua Hopkins, of the mayor’s Office of Community Relations & Services, announced that the mayor would bring his “Fix-It” program to ANC 6D from 9-11 a.m. on Tuesday, November 17.  He promised to inform the ANC of the meeting point November 17, and to update the ANC on progress repairing problems the ANC has brought to his attention.

     g.  Buzzards Point.

Naomi Mitchell announced an ANC briefing Monday, November 16, and a town meeting Wednesday, November 18, on plans to redevelop Buzzards Point, the area south of V St. between Fort McNair and the Frederick Douglass Bridge.
 
     h.  Safeway Liquor License.

Coralie Farlee, chair of the ANC Alcohol Beverage Control Committee, reported on negotiations with Safeway regarding its application for a liquor license.  Dr. Farlee does not expect her committee, the ANC Southwest Safeway Task Force, or a trained attorney (other than Safeway’s lawyer) to review her draft agreement before she presents it to the ANC for a vote at its December meeting.

     i.  Parade of Lights.

Southwester editor Glenn Favreau announced that, in the late afternoon Saturday December 5, the Harbor Boat “Parade of Lights” will take place off the Southwest Waterfront.

     j.  Canal Park.

Chris VanArsdale, executive director of the Canal Park Development Association (CPDA), reported on current design plans for Canal Park.  When completed, Canal Park will occupy the three square blocks between 2d and Canal Streets, SE, and M and I Streets, SE.  The park’s amenities will include pavilions, an ice-skating rink, and a full-service restaurant.  CPDA expects to start construction in August 2010.  VanArsdale promised to consult with the CPDA board about adding, to the board, returning residents of the Arthur Capper housing project.

     k.  Early Stages Program.
 
Samuel McCormally of the DC Public Schools (DCPS) described DCPS’s “Early Stages” program, which identifies and assists children 3-5 years old who have developmental delays.

     l.  Treasurer’s Reports.

         1)  Monthly report.

Commissioner Jorgensen moved/Commissioner Siegel seconded to accept the treasurer’s report for November 2009, a copy of which is attached to these minutes.  The motion passed 2-1, with Commissioner McBee opposed.  Commissioner Sobelsohn abstained.  Commissioners Hamilton and Litsky did
not vote.

         2)  Fiscal Year 2010 budget.

Commissioner Jorgensen moved/Commissioner McBee seconded to approve a proposed 2010 budget, a copy of which is attached to these minutes.  The motion passed 4-1, with Commissioner Sobelsohn opposed.  Commissioner Litsky did not vote.

7.  Adjournment.

Commissioner Sobelsohn moved/Commissioner McBee seconded to adjourn.  The motion passed without objection, and the meeting adjourned at 9:36 p.m.

ANC 6D  Recommended Changes in the Security Plan for Ziegfeld’s/Secret’s

 

At 1824 Half Street, SW

November 2009

 

 

1.      Add language that any criminal assault shall be recorded in the log book [#2];

  1. add provisions for requesting off-duty reimbursable MPD details [?section 3?];
  2. add that security personnel need to be clearly identified with t-shirts and with name [section 4A];
  3. add provision for security on Tuesdays [VA indicates open on Tuesdays, no mention in Security Plan, section 4A];
  4. Re cameras and recording equipment, ensure recordings are saved and available for 30 days [#4];
  5. Incorporate language to ensure that all employees annually receive update to security training [#6];
  6. Add language that any criminal assault shall be recorded in the log book [#2];
  7. Add language to ensure that, to the best of [our] the ability [of the owner] any crime scene shall be secured until the arrival of MPD and that no crime scene shall be tampered with, cleaned, or otherwise handled until approval is given by MPD that the scene is no longer needed [#7]
