Minutes

As Proposed by ANC 6D Secretary


Commissioner Litsky called the meeting to order at 7:04 p.m.

Present: Commissioners Hamilton, Jorgensen, Litsky, McBee, Moffatt, Siegel, Sobelsohn.

1.  Agenda.

Commissioner Sobelsohn moved/Commissioner Jorgensen seconded to approve the agenda as proposed.  Commissioner Jorgensen moved to amend the motion to replace, in the proposed agenda, “Fiscal Year 2010 Budget” with “Quarterly Report.”  Without second or objection, the motion was ruled so amended.  As amended, the motion passed 5-0.  Commissioners Hamilton and Moffatt did not vote.

2.  September Minutes.

Commissioner Sobelsohn moved/Commissioner Siegel seconded to approve the proposed September 14, 2009 minutes.  Commissioner Sobelsohn moved to amend the motion to replace, as the location of the September meeting, “St. Augustine’s Episcopal Church” with “Courtyard by Marriott.”  Without second or objection, the motion was ruled so amended.  As amended, the motion passed 6-0.  Commissioner Moffatt did not vote.

3.  DC City Council Proposal.

Commissioner Sobelsohn moved/Commissioner Siegel seconded to pass a resolution supporting B18-0482, the Religious Freedom and Civil Marriage Equality Amendment Act of 2009.  A copy of the resolution is attached to these minutes.  The motion passed 7-0.

4.  Zoning and Construction.

     a.  6th and I Street Park.

Commissioner Jorgensen moved/Commissioner Sobelsohn seconded to send a letter to the Department of Parks and Recreation (DPR) requesting that DPR replace the pond pump in the park at 6th and I Street before DPR refills the pond next spring.  The motion passed 6-0.  Commissioner Moffatt did not vote.

     b.  Florida Rock.

On November 9 the Zoning Commission will consider Florida Rock Properties’ application for a two-year extension of its Planned Unit Development (Zoning Commission Order No. 04-14) for a mixed-use multiple-building project in the 100 block of Potomac Avenue, SE--just south of Nationals Park.  The extension would require that Florida Rock file its initial building-permit application by June 26, 2012.  Commissioner Siegel moved/Commissioner Sobelsohn seconded to support the application.  The motion passed 5-2, with Commissioners Hamilton and Moffatt opposed.

     c.  Navy Yard Bed and Breakfast.

On November 17 the Board of Zoning Adjustment (case #17992) will hear Paul Broom’s application for a special exception to operate a six-room bed-and-breakfast at 1026 3d St., SE.  Since the property is currently in a residential zone, the special exception is required for Broom to rent rooms on a daily and weekly basis.  Broom assured the ANC that he won’t rent to walk-ins but only to those who reserve in advance; he’ll forbid alcohol and tobacco; and he won’t cook food for his guests.  Commissioner Sobelsohn moved/Commissioner Siegel seconded to support the application.  The motion passed 7-0.

5.  Public-Space Permit.

The Gynecological Cancer Foundation (GCF) has applied for a permit to hold a race to raise funds to fight gynecological cancer.  The race will start 7 a.m. Sunday November 8, stay north of the Southeast-Southwest Freeway, and clear out of ANC 6D by 10:30 that morning.  A copy of the proposed race route is attached to these minutes.  Representing GCF, Lisa Marie Czop promised to (a) provide ANC 6D with notices commissioners can distribute, (b) place something about the race in the November 2009 Southwester, and (c) inform ANC 6D regarding possible breaks in the race to permit through-traffic and also how the race will affect the #30 and the #70 buses.  Conditioned on these promises, Commissioner Sobelsohn moved/Commissioner Jorgensen seconded to support CFG’s application.  The motion passed 7-0.

6.  Announcements and Reports.

     a.  Announcements.

          1)  Upcoming ANC Meeting.

Commissioner Litsky announced that the ANC will hold its next public business meeting starting 7 p.m. Monday, November 9, at St. Augustine’s Episcopal Church, 600 M St., SW.

          2)  Department of Transportation.

Commissioner Litsky reported that the DC Department of Transportation has reopened the 9th Street tunnel.

          3)  Old Friendship Baptist Church.

Commissioner Litsky announced that the owner of the Old Friendship Baptist Church has applied to the Zoning Commission to extend its Planned Unit Development, that the Zoning Commission is hearing the application October 19, and that the ANC has requested the Zoning Commission to delay its decision for two months to give the church’s owner opportunity to appear before the ANC.

     b.  Reports.

          1) ABC Committee.

Coralie Farlee, chair of the ANC 6D Alcohol Beverage Committee, reported on her committee’s October 14 meeting.  Commissioner Moffatt moved/Commissioner Siegel seconded to recommend that the ANC 6D Southwest Safeway Task Force outline in writing its concerns regarding a possible voluntary agreement between the ANC and Safeway regarding Safeway’s Class B liquor-license application.  The motion passed 5-1, with Commissioner Sobelsohn opposed.  Commissioner Hamilton abstained.

          2)  Treasurer.

               a)  Monthly Report.

Commissioner Jorgensen moved/Commissioner Siegel seconded to accept the treasurer’s report for October 2009, a copy of which is attached to these minutes.  The motion passed 5-1, with Commissioner Sobelsohn opposed.  Commissioner McBee abstained.

               b)  Quarterly Report.

Commissioner Jorgensen moved/Commissioner Moffatt seconded to accept the treasurer’s July-September 2009 Quarterly Report, a copy of which is attached to these minutes.  The motion passed 7-0.

               c)  2010 Allotment.

Commissioner Jorgensen reported that ANC 6D would receive $18,688 as its allotment for fiscal year 2010.

7.  Community Concerns and Audience Time.

ANC 6D resident Elaine F. Graves announced a St. Augustine’s Episcopal Church fundraiser 8 p.m.-midnight October 30 at Hogate’s by Kristina, 800 Water St., SW.

Joshua Hopkins, the mayor’s Ward Six Outreach and Service Specialist, announced an upcoming “Operation Fix-It” for ANC 6D, during which the city hopes to make comprehensive repairs of city property.  Commissioner Litsky urged ANC 6D commissioners to provide a list of needed repairs to ANC 6D administrative assistance Bert Randolph by November 2.

Jason Kopp, president of the Gangplank Slipholders Association, invited help planting 22 trees, on Maine Avenue, SW, between 6th and 7th Streets, in the morning of Saturday November 7, starting 9 a.m.

ANC 6D resident Nancy Masterson spoke about 1st District police communications.

Southwest Neighborhood Assembly (SWNA) president Carolyn Mitchell announced a SWNA town meeting 7 p.m. Monday, October 26, at the Courtyard by Marriott, 140 L St., SE.

8.  Extension of Time and Adjournment.

Commissioner Jorgensen moved/Commissioner Siegel seconded to extend the time of the meeting to 9:15 p.m.  The motion passed 6-1, with Commissioner Sobelsohn opposed.  At 9:20, Commissioner Sobelsohn moved/Commissioner Siegel seconded to adjourn.  The motion passed 7-0.  The meeting adjourned at 9:20 p.m.
